Terms of Service

These Terms and Conditions ("Terms") govern your use of the LyteFast iOS mobile application and any related services (collectively, the "Service") provided by LyteFast, a SASU registered in France ("LyteFast", "we", "us", or "our").

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service.

1. Eligibility

By using the Service, you represent and warrant that:

  • You are at least 18 years old, or you have the consent of your parent or legal guardian;
  • You have the legal capacity to enter into a binding agreement; and
  • You will comply with these Terms and all applicable laws and regulations, including those of France and the European Union.

    • If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, and in that case "you" and "your" will refer to that entity.

    2. Your Account

    To use certain features of LyteFast, you may be required to create an account.

    You agree to:

  • Provide accurate, current, and complete information during registration and keep it updated;
  • Maintain the confidentiality of your login credentials; and
  • Immediately notify us at contact@lytefast.com of any unauthorized use of your account or any other security breach.

    • You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate your account if we reasonably believe that you have violated these Terms.

    3. Subscriptions and In-App Purchases

    LyteFast offers paid subscriptions and in-app purchases ("Paid Services") available through the Apple App Store.

    3.1 Billing and Payment

  • All purchases and subscriptions are processed by Apple via your Apple ID. We do not collect or store your full payment information.
  • The price of subscriptions and in-app purchases is displayed in the App Store in your local currency (e.g. EUR in France), inclusive of applicable taxes unless otherwise stated.
  • By confirming a purchase, you authorize Apple to charge the applicable fees to your selected payment method.

    • 3.2 Auto-Renewing Subscriptions

    Some LyteFast features are accessible only with an auto-renewing subscription:

  • Subscriptions are billed in advance on a recurring basis (e.g. monthly or yearly, as shown in the App Store).
  • Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the end of the current period.
  • You can manage or cancel your subscription at any time via Settings > [your name] > Subscriptions on your iOS device.

    • 3.3 Free Trials

    We may offer free trials for certain subscription plans:

  • If you sign up for a free trial, you will gain access to the Paid Services for the duration of the trial.
  • At the end of the trial period, your subscription will automatically convert to a paid subscription and your payment method will be charged, unless you cancel before the trial ends.
  • We reserve the right to modify or cancel free trial offers at any time.

    • 3.4 Refunds

    Because payments are processed by Apple, any refund requests must be made directly through Apple's App Store according to their policies.

  • To request a refund, you must follow the process provided by Apple (e.g. reportaproblem.apple.com or through your purchase history).
  • To the extent permitted by applicable law, we are not responsible for issuing refunds directly.

    • Nothing in these Terms affects your statutory rights as a consumer under applicable French and EU law.

    4. License and Use of the Service

    Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download, install, and use LyteFast on devices that you own or control; and
  • Access and use the Service for your personal, non-commercial use.

    • You agree not to:

  • Copy, modify, adapt, translate, reverse engineer, decompile, or disassemble any part of the Service, except where such restrictions are prohibited by law;
  • Circumvent or attempt to circumvent any security or access control of the Service;
  • Use the Service for any illegal or unauthorized purpose.

    • 4.1 Service Features and Usage Limits

    Certain AI-powered features of LyteFast are subject to daily usage limits:

  • Food Scanning (AI Photo Analysis): Limited to 25 scans per day
  • Barcode Scanning: Limited to 100 scans per day
  • Food Text Analysis: Limited to 100 analyses per day

    • These limits are applied on a per-user, per-day basis and reset at midnight in your local time zone. We reserve the right to modify these limits at any time, with reasonable notice provided through the Service or these Terms.

    5. User Content

    LyteFast may allow you to enter or upload content such as text, notes, logs, or other data ("User Content").

    You retain ownership of your User Content. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, process, and display your User Content solely for the purpose of operating, maintaining, and improving the Service.

    You confirm that:

  • You have all necessary rights to your User Content;
  • Your User Content does not infringe any third-party rights or violate any law; and
  • Your User Content complies with these Terms and our policies.

    • We may remove or restrict access to User Content that we reasonably believe violates these Terms or applicable law.

    6. Acceptable Use / Prohibited Activities

    You agree not to use LyteFast to:

  • Violate any applicable law or regulation, including data protection and privacy laws;
  • Infringe the rights of others, including intellectual property, privacy, and personality rights;
  • Upload or transmit any viruses, malware, or other harmful code;
  • Attempt to gain unauthorized access to the Service, other user accounts, or our systems;
  • Use automated means (such as bots, scrapers, or spiders) to access the Service in a way that may disrupt or overload our infrastructure;
  • Harass, threaten, or harm any person.

    • We may take any appropriate action (including suspension or termination of access) if we reasonably believe you are in breach of this section.

    7. Intellectual Property

    All rights, title, and interest in and to the Service, including the LyteFast app, software, design, text, graphics, logos, and other content (excluding User Content) are and will remain the property of LyteFast or its licensors.

    You may not use our trademarks, logos, or brand elements without our prior written consent.

    8. Third-Party Services

    The Service may include links or integrations with third-party websites, services, or content that we do not own or control.

    We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. Your use of any third-party services is at your own risk and subject to the terms and conditions of those third parties.

    9. Privacy

    Your use of LyteFast is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

    By using the Service, you agree that we may process your personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR) and French data protection law.

    10. Disclaimer of Warranties

    To the maximum extent permitted by law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis.

    We do not warrant that:

  • The Service will be uninterrupted, error-free, secure, or available at all times;
  • Any defects or errors will be corrected; or
  • The results obtained from using the Service will be accurate or meet your expectations.

    • To the extent permitted by law, we exclude all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

    Nothing in these Terms excludes or limits any warranty or liability that cannot be excluded or limited under applicable French or EU law.

    11. Limitation of Liability

    To the maximum extent permitted by applicable law, LyteFast and its directors, officers, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages;
  • Any loss of profits, revenue, data, or business opportunities;
  • Any loss or damage arising from your use of, or inability to use, the Service.

    • To the extent permitted by law, our total aggregate liability arising out of or in connection with the Service or these Terms shall be limited to the greater of:

  • The amount you have paid to us for the Paid Services in the 12 months preceding the event giving rise to the claim; or
  • 50 EUR, unless a higher minimum is required under applicable law.

    • Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under French law, including liability for death or personal injury caused by negligence or for fraud.

    12. Indemnification

    You agree to indemnify, defend, and hold harmless LyteFast and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

  • Your use of the Service;
  • Your breach of these Terms; or
  • Your violation of any law or the rights of any third party.

    • 13. Termination

    We may suspend or terminate your access to the Service at any time, with or without notice, if:

  • You breach these Terms; or
  • We decide, in our reasonable discretion, to discontinue the Service.

    • Upon termination:

  • Your right to use the Service will immediately cease;
  • Certain provisions of these Terms that by their nature should survive termination (such as intellectual property, limitation of liability, and indemnification) will continue to apply.

    • You may stop using LyteFast at any time by deleting the app from your device and, if applicable, cancelling your subscription via your Apple ID settings.

    14. Changes to the Service and Terms

    We may modify or update the Service and these Terms from time to time.

    If we make material changes to these Terms, we will take reasonable steps to inform you, for example by:

  • Updating the "Last updated" date at the top of these Terms; and/or
  • Displaying a notice within the app or via the App Store.

    • Your continued use of LyteFast after the changes become effective will constitute your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service.

    15. Governing Law and Jurisdiction

    These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law rules.

    Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France, without prejudice to any mandatory rights you may have as a consumer under applicable law.
